1. Who we are

FluxAudio ("FluxAudio", "we", "us") operates the web shop at fluxaudio.nl and fluxaudiosamples.com, selling digital audio products such as sample packs, presets, project templates and memberships.

2. Applicability

These Terms of Service apply to every account, order and download on FluxAudio. By creating an account or placing an order you accept these terms. Deviations are only valid when agreed in writing.

3. Your account

You must be 16 years or older, or have permission from a parent or guardian. Provide accurate information and keep your sign-in credentials (including two-factor recovery codes) private. Your account is personal: sharing an account or its downloads is not allowed. You are responsible for activity on your account. We may suspend accounts that violate these terms (see section 12).

4. Products and prices

All products are digital goods. Prices are shown in euros and include Dutch VAT where applicable. Prices shown in other currencies are indicative — payments are always processed in euros. Obvious errors in pricing or product descriptions may be corrected, and orders based on them may be cancelled with a full refund.

5. Ordering and payment

Payment is handled by PayPal (including card payments through PayPal). An order is complete when PayPal confirms the payment. Access to your purchase is granted immediately after confirmation. If a payment is pending (for example an eCheck), access follows as soon as the payment clears.

6. Delivery and right of withdrawal

Purchases are delivered instantly to the library of your account. By completing a purchase you expressly consent to immediate delivery of the digital content and acknowledge that you thereby waive your statutory 14-day right of withdrawal as soon as the content is delivered (Article 6:230p of the Dutch Civil Code / EU Consumer Rights Directive).

7. License

Upon full payment you receive a personal, non-exclusive, non-transferable, worldwide, royalty-free license to use the purchased sounds, presets and templates in your own music productions, including commercial releases.

Not allowed, in any form:

• reselling, redistributing or sharing the files themselves (free or paid);
• including the content in another sample pack, preset pack or similar product;
• sublicensing, renting out or transferring the license;
• uploading the files to file-sharing platforms or public repositories;
• using the content to train or feed machine-learning / AI models.

The VIP Member Pass grants this same license for the products it unlocks, for as long as the pass is offered as lifetime access. All licenses are bound to your account.

8. Intellectual property

All content sold or shown on FluxAudio remains the property of FluxAudio and/or its licensors. Purchasing grants a license as described in section 7 — never ownership of the underlying works.

9. Acceptable use

You will not: attack, overload or attempt to bypass the security of the site; scrape or copy the catalog; use bots to purchase; or use the platform for anything unlawful.

10. Availability and support

We aim to keep FluxAudio available at all times but do not guarantee uninterrupted service. Support is available via the messages feature in your account and via our Discord community.

11. Liability

To the extent permitted by law, our total liability for any claim is limited to the amount you paid for the product concerned. We are not liable for indirect damage, including lost profits or lost data. Nothing in these terms limits liability for intent or gross negligence, or any liability that cannot be excluded by law.

12. Suspension and termination

You can stop using your account at any time; contact us to have it deleted. When an account is deleted, access to purchased downloads ends. We may suspend or terminate accounts that violate these terms — where reasonable, with prior notice and a stated reason. Payments for delivered digital content are not refunded in that case.

13. Changes to these terms

We may amend these terms. Material changes will be announced on the site or by email. The current version is always available at /terms. Continued use after a change means acceptance of the amended terms.

14. Governing law and disputes

Dutch law applies. Disputes are submitted to the competent court in [DISTRICT], the Netherlands, unless mandatory consumer law provides otherwise. EU consumers may also use the European ODR platform (ec.europa.eu/consumers/odr).
